Legal Indemnity Insurance

Legal Indemnity Insurance (LII) provides protection for buyers and lenders involved in residential or commercial property transactions where a defect in title cannot be resolved.

LII is commonly used during conveyancing when a legal issue exists — such as a missing landlord, lack of planning permission or building regulation approval, absence of rights of way, or defective lease arrangements — that is unlikely to cause an immediate problem but could result in significant financial loss in the future.

Rather than delaying or jeopardising a transaction, Legal Indemnity Insurance offers a practical, low-cost alternative to correcting the defect itself. Policies are paid for by a single, one-off premium and typically last for the life of the property, automatically transferring to future owners or lenders.

Importantly, while the policy does not remedy the defect, it provides financial protection should a loss arise as a result of the insured issue. LII is often used to allow transactions to complete quickly where resolving the defect would be impractical, time-consuming, or impossible.
